Article 1: Scope of application

These general conditions apply to the purchase of non-personalized products, without the intention of reselling by non-professional buyers on the Esthet Studio website.

Personalized products mean products presented in the “made to measure” category and produced according to specifications specific to each customer who orders them and are not governed by these general conditions of sale.

Any order or pre-order for a product appearing in the online store of the website www.esthetstudio.com requires prior consultation of these general conditions and their acceptance.

You must read and accept these Termes & Conditions prior to each order by checking the box provided for this purpose “I have read and accept the General Conditions of Sale of Esthet Studio and I undertake to pay for my order”.

Esthet Studio reserves the right to adapt or modify these Terms & Conditions at any time in order to comply with the legislative and regulatory changes applicable to sales contracts concluded at a distance or in the event of changes in its sales activity of ready-to-wear products.

Terms & Conditions thus modified will only be applicable to purchases made after this update.

The applicable version of the Terms & Conditions is always the one appearing on the site at the time of the pre-order or the order.

Article 2: Registration on the site

To be able to place an order, it is necessary to create a customer account on the Esthet Studio site which will gather and store your information in the perspective of your future orders.

These Terms & Conditions apply in their entirety.

By placing an order, you declare that you are of legal age and have the necessary legal capacity to enter into a contract.

Article 3: Products

Pursuant to Article L.111-1 of the Consumer Code, Esthet Studio makes available to you, prior to the conclusion of the sales contract, the products offered for sale as well as their essential characteristics.

Photos representing the products are only indicative. These photos, like the texts illustrating the products, are not contractual. The photos on the site will not always reflect accurately the final product you will receive.

In accordance with European legislation, the fiber composition of the clothing offered for sale by Esthet Studio is available for each product and displayed on the site.

The products available for pre-orders by Esthet Studio are only available within the limit of the pre-order period announced and only on condition that the minimum number announced of pre-ordered products is reached (hereinafter “Pre-order”).

Each pre-order campaign is the subject of information, permanently available on the site, relating to the duration of this campaign and the minimum number of units required to launch the pre-order from our suppliers.

Products remaining in stock following delivery and possible return of pre-ordered products are only offered within the limits of available stocks (hereinafter “Ordering products in stock”).

Article 4: Pre-orders and orders

4.1. Pre-orders

Placing a pre-order is subject to compliance with the procedure set up by Esthet Studio, which includes successive steps leading to its validation (selection of items, viewing your basket, choice and delivery terms, validation and confirmation of your order, payment).

Before proceeding with the validation of the pre-order, you must read and fully accept these Terms & Conditions and the essential characteristics of the products.

In accordance with article L.221-13 of the Consumer Code, you will then receive electronically, which you accept, a summary confirmation of your pre-order. In any case, invoices are delivered with the summary confirmation of your order or upon delivery.

In the event of a pre-order, the sums paid in advance do not constitute a deposit, within the meaning of article 1590 of the Civil Code.

If the minimum objective of a pre-order campaign is not reached, Esthet Studio will contact you at the end of the campaign to inform you of its reimbursement or production decision.

In this case, Esthet Studio will refund your pre-order within 14 working days of the cancellation of the pre-order.

4.2. Product orders in stock

Placing an order for products in stock is subject to compliance with the procedure set up by Esthet Studio which includes successive steps leading to its validation (selection of items, viewing your basket, choice and delivery terms, validation and confirmation of your order, payment).

Before validating the order, you must read and fully accept these GTC and the essential characteristics of the products.

In accordance with article L.221-13 of the Consumer Code, you will then receive electronically, which you accept, a summary confirmation of your order. In any case, invoices are delivered with the summary confirmation of your order or upon delivery.

If the product is in stock, the order will be executed no later than 7 days from the day following the day you done your order. In case of unavailability of the ordered product, in particular because of the suppliers, you will be informed as soon as possible and will have the possibility of canceling your order. You will then have the choice to request the exchange of the product within 15 days at the latest after receipt or to be reimbursed.

The refund will be made no later than 14 days following the cancellation of the order.

Article 5: Prices and payment terms

5.1. Price

Prices indicated on Esthet Studio website are expressed in euros, including VAT.

Prices appearing on the site are indicated in euros including all taxes and are only valid on the date of validation of your order.

VAT is applied at the rate in force in mainland France at the time of the order.

The prices do not take into account the delivery costs, which can be invoiced in addition and indicated before the validation of your order (see “Delivery”).

For deliveries outside the European Union and in the French overseas departments and territories, the order will be made tax free. If customs duties, import taxes or applicable local taxes are due, these costs are the responsibility of the customer and are their sole responsibility. It is recommended that you carry out the necessary checks and procedures before confirming your order.

Esthet Studio reserves the right to change the price of a product from one pre-order period to another without this change affecting a pre-order or an order already placed.

5.2. Payment terms

The products are payable in euros on the day of the actual order. To pay for your order, the following payment methods are accepted:

• Credit card:

For payment by credit card, you must provide your bank card number, associated with its expiration date as well as the cryptogram numbers on the back of your bank card. In order to ensure the security of payments made online, you access a dedicated space made available by the company Revolut Business, which ensures the security and recording of the payment order and the security of the payment itself. In this regard, you expressly acknowledge that the communication of your bank card number to the company Esthet Studio through the company Revolut Business constitutes authorization to debit your account up to the amount of the products ordered.

The accepted cards are: Visa, Mastercard

• Paypal:

With PayPal your financial information is never communicated to Esthet Studio. Indeed, PayPal encrypts and protects your card number. Pay online by simply entering your email address and password. This implies acceptance by the customer of the PayPal terms of use.

Esthet Studio reserves the right to suspend or cancel any order or pre-order in the event that your authorization to pay by credit card is refused or in the event of non-payment.

Esthet Studio also reserves the right to refuse or cancel an order or pre-order from a Customer with whom a payment dispute is in progress or has taken place during a previous order or pre-order or in the event of objective suspicion of fraud.

The delivered goods remain the property of Esthet Studio until receipt of payment. The transfer of risk to the customer takes place upon delivery of the products.

Article 6: Shipping

6.1. Terms of delivery

Deliveries are made by COLISSIMO or DHL.

They are made to the delivery address indicated by the customer, which must correspond to his address of residence, to the address of any other natural person of his choice or to his business address.

Delivery cannot be made to hotels or PO boxes.

The customer must ensure that they provide Esthet Studio with accurate and complete information relating to the delivery address.

In the event of an error in the wording of the contact details of the recipient of the package, Esthet Studio cannot be held responsible for the impossibility of making this delivery.

In case of absence or impossibility of delivery of the parcel, COLISSIMO will leave you a transit advice note mentioning the address of the post office where you can collect it on presentation of an identity document, and the date on which it will be available there.

In the event that the parcel is not or cannot be delivered, DHL will leave you a calling card to schedule a new delivery.

6.2. Delivery delay

When a product is offered for pre-order, it is because it has not yet been produced.

The manufacture of the products is only started after the end of the pre-order period with our suppliers and provided that the minimum manufacturing quantities have been reached.

The times between your pre-order and delivery vary depending on the type of product offered and its manufacturing requirements.

You will be regularly informed of the manufacturing steps and the progress of your order.

As soon as the pre-order period ends and after checking with our suppliers and manufacturers of the manufacturing times, you will be informed of the final delivery time of your Esthet’s product. The estimated delivery date is marked on the product sheet and you will be reminded of it in the email you receive when you place an order.

In any case, the maximum delivery time for pre-order products will be 4 months from the end of the pre-order campaign.

In the event of an order for products in stock, they will be delivered within three weeks after the placing the order on our site.

Once the package has been dispatched, Colissimo delivery time is 3-4 days for France, 3-8 days for other destinations.

6.3. Delivery tracking

When sending your package, you will receive an email confirmation containing the link that allows you to follow the progress of your delivery.

6.4. Shipping costs

The delivery charges applicable to our products are as follows:

• Free shipping in France for any order greater than or equal to 100 euros
• Free shipping in Europe for any order greater than or equal to 150 euros
• Free international shipping (outside Europe) for all orders over 200 euros.

In France, the price of shipping will be 5 euros.

In Europe, the price of shipping will be 10 euros and internationally 30 euros.

6.5. Receipt of products and transfer of risk

According to Articles L.216-3 et seq. of the Consumer Code, any risk of loss or damage to goods is transferred to the Customer when the latter, or a third party designated by him, and other than the proposed carrier by Esthet Studio, takes physical possession of these goods.

Delivery is considered to have been made upon delivery of the product to the Customer by the carrier, as evidenced by the control system used by the latter.

Upon receipt of the products during delivery, you are invited to check the apparent condition of the packaging and the product and to report any damage to the carrier on the delivery slip as well as to Esthet Studio as soon as possible.

As an exception, the risk is transferred to the Customer upon handing over the product to the carrier when he entrusts the delivery of the goods to a carrier other than that offered by Esthet Studio.

Article 7: Right of withdrawal

According to article L.221-18 of the Consumer Code, you have 14 days from the day after receipt of your product to exercise your right of withdrawal, without having to justify or justify your decision.

The right of withdrawal can be exercised online, by sending us an email to contact@esthetstudio.com. Esthet Studio will send you an electronic confirmation without delay.

You must return your product no later than 14 days following the sending of your withdrawal using the return slip provided by Esthet Studio to the address which will be indicated.

The return is the responsibility of the customer outside mainland France (only the direct cost of shipping).

The product must be returned in its original packaging, in its original condition, new, unworn, unwashed, for an exchange or refund.

Esthet Studio will reimburse you for the full amount of your order, on the day on which the order to which your withdrawal relates has been received by us, using the same means of payment to make this reimbursement as that used for the payment of the order.

At the end of the withdrawal period, the sale is firm and final.

Article 8: Returns, exchange and refund

You have 14 days from the day after receipt of your product(s) to return it (them) to us for a refund or to make an exchange.

Your return request can be made online, by sending us an email to contact@esthetstudio.com. Esthet Studio will send you an electronic confirmation without delay.

You must return your product no later than 14 days following the sending of your withdrawal using the return slip provided by Esthet Studio to the address which will be indicated.

Return is free from mainland France.

The return at the expense of the Customer outside mainland France (only the direct cost of shipping) except in the case of a product that does not comply with your order, in which case the support will be at our expense.

Delivery charges or any other taxes applicable to the order are not refundable.

The product must be returned in its original packaging, in its original condition, new, unworn, unwashed.

Exchange will be possible depending on the stocks.

Otherwise, we will refund your entire order.

The refund will be made within 7 days of receipt of your return product.

The exchanged product will be sent to you within 10 days.

Article 9: Responsibility

We do everything possible to satisfy you. We are responsible for the proper execution of these Terms & Conditions. However, our responsibility cannot be incurred due to a fortuitous event, a case of force majeure, the unforeseeable and insurmountable fact of a third party to the contract or because of the non-compliance of the product with foreign legislation in the event of delivery in a country other than France, use of the product for professional purposes, negligence or lack of maintenance on the part of the customer or normal wear and tear of the product.
